Rodrigo Cervantes Zavala, 35, was arrested three months ago near Puerto Vallarta in the state of Jalisco. His 3-year-old daughter and 18-month-old son were returned home, unharmed, to their mother shortly afterward.

The mother, Isabel Acosta, was Cervantes’ ex-girlfriend. Authorities say Cervantes entered her home the night of July 10, killed her parents and brother then took young Jennifer and Bryan.

A Mexican judge recently recommended that Cervantes be extradited to the United States to face charges of first-degree murder and kidnapping. Cervantes did not contest the extradition.

Maricopa County Sheriff Joe Arpaio said it’s very unusual for a suspect to be returned to the United States this quickly.

In most cases when a homicide suspect is caught in Mexico, American authorities agree to waive the death penalty so that extradition can proceed. Mexico does not have capital punishment.

Arpaio and Mexican consul general Carlos Flores Vizcarra refused to comment whether a deal over the death penalty was made.
